  • Acceptance of the terms and conditions

Thank you for choosing MedTrip services. Website and Registered Trademark of MedTrip Mexico, hereinafter referred to as the "SITE", when having access to this website, the "SITE", and when completing a medical trip reservation through the "SITE" or the CONTACT CENTER accepts these terms and conditions, so you should review them carefully before continuing. In the event that the "USER" does not agree to be bound by these terms and conditions, they must immediately suspend their use or reservation. The terms and conditions set forth in this document are subject to change without prior notice.

 

  • Definitions

For all purposes of the Terms and Conditions established herein, the following definitions shall be understood:

 

  • Medical Tourism Agency (Operator) - MedTrip México Company, which contracts and / or acts as an intermediary through its official page www.medtripmx.com, for the benefit of a "USER", regarding the medical and tourist services provided by directly by a final SUPPLIER, hereinafter this company will be called "MEDTRIP".

 

  • Website - www.medtripmx.com - Website owned by MedTrip México, who acts as an intermediary, offering the "USER" through the internet, the various tourist services provided directly by a SUPPLIER, hereinafter referred to as " SITE".

 

  • Contact Center - Area that belongs to the MEDTRIP Sales department, whose main activity is to assist the medical traveler, book packages or become the main advisor of the MedTrip experience.

 

  • User or client - Person who uses the "SITE" www.medtripmx.com, in order to make use of the intermediation and the reservation engine of "MEDTRIP", in order to enjoy any of the medical or tourist services provided by directly by the final SUPPLIER, hereinafter referred to as "USER".

 

  • Provider - Natural or legal person who directly provides medical and tourist services to the "USER", contracted, reserved or acquired by the latter through the intermediation of MEDTRIP.

 

  • Object

It consists of the INTERMEDIATION that will exist between the www.medtripmx.com site or the CONTACT CENTER, the "USER" and the SUPPLIERS, where MEDTRIP for the purposes of these Terms and Conditions, will act solely and exclusively as INTERMEDIARY, from its operations center located in the city of Colima, Colima, Mex., providing the "USER" through its "SITE", but not limited to, the reservation service for online medical consultations, plastic surgery procedures, orthopedics, bariatric, land and air transportation; Reservation in hotels and lodging establishments; Reservation of Medical Tourism packages, among others, so once the reservations are confirmed to the "USER" by MEDTRIP containing the tourist and medical services chosen by the "USER" (according to their availability), it will be concluded with the provision of the intermediation service by MEDTRIP, since said tourist services will be provided to the "USER" by the SUPPLIERS directly.

 

  • Reservation policies

The rates shown on the "SITE" www.medtripmx.com , and in the quotes accepted by the "USER", will be maintained only in the event that the client reserves and complies with the specified payment policies, otherwise the rates may vary. Medical tourism packages without exception will include: online assessment, procedure, equipment, medical supplies and fees, basic laboratory tests, insurance for additional medical expenses for medical complications, as well as private local transportation and lodging.

A reservation is considered complete, when the "USER" has provided all the necessary data and has the confirmation number. At the time of booking, the "USER" authorizes MEDTRIP to validate the data provided during the transaction and expressly confirms that they know and accept the Terms and Conditions, as well as the privacy policy. All reservations are subject to availability at the time of processing your request. In some cases, availability must be verified directly with the SALES department, before being able to confirm the reservation to the USER; MEDTRIP will take a maximum of 24 hours to carry out said availability verification and confirmation, this cannot be guaranteed if it does not have a minimum payment of 1,000 USD.

In order to avoid setbacks, the "USER" must save his reservation number in order to print the travel support documents that MEDTRIP will issue. All reservations must be settled before making it valid, with the possibility of paying up to seven days before the medical trip. The client must liquidate his package before the reserved date and present his receipt of total payment at the time of making his reservation valid.

If the "USER" wishes to change or cancel his reservation, he must contact any of our consultants at the CONTACT CENTER, mentioning his reservation number. MEDTRIP suggests that you carefully read the clause corresponding to the CANCELLATION POLICIES. Any change of reservation is subject to availability and re-quoting of rates. For more information, the "USER" should contact his advisor mentioning his reservation number. Every reservation confirmed by MEDTRIP provides a confirmation number, which the "USER" must keep at all times.

 

  • Payment policies

The total amount corresponding to your reservation will be charged immediately by MEDTRIP, to the credit card data that the "USER" provides, for this purpose, as long as the status of your reservation shows that it is confirmed, and will appear in your status Account with the legend: MEDTRIP or with the legend equivalent to the SUPPLIER. For the payment of your reservation, we accept Visa and Master Card Credit Cards. If the "USER" does not have any of these credit cards, he can send a bank transfer or pay through PayPal, by contacting our CONTACT CENTER.

 

The rates published on our "SITE" are quoted in US dollars, which will be charged in US dollars. In the case of any other type of currency, the amount of the transaction will be converted to US dollars at the exchange rate in effect on the date of the transaction, taking into account that the amount that will appear on your payment receipt may vary for reasons. of the international fluctuation of the currency exchange rate, and that some banks charge a tax, interest or foreign transaction fee and this is foreign to MEDTRIP. It is the customer's responsibility to cover them.

 

If you require a tax invoice, please request it at the time of payment or settlement of the reservation, directly with your advisor. It is worth mentioning that for tax reasons the invoices will be prepared after generating the payment or after having performed the reserved medical procedure (s). Once the invoice is issued, no changes are allowed.

 

  • General cancellation policies

MEDTRIP reserves the right to contract on behalf of the "USER", the services to which it refers and which are specified in these Terms and Conditions precisely in the quality and / or contracted categories, in terms of carriers, hotels and medical procedures are refers, regardless of the ultimate provider of the services, unless it is expressly agreed that these will be invariably provided by a specific SUPPLIER. In case of modification of the direct PROVIDER of the service, this will be provided by another of equivalent quality, if the "USER" makes use of the service, it will be understood that he consented to said modification and no claim, compensation or refund will proceed. Once MEDTRIP receives from the "USER" the amount of the contracted services, be they air, land, lodging, as a whole (package) or any other, MEDTRIP has the immediate authorization of the "USER" to issue, issue or acquire the air tickets in your name, adhering to and accepting both MEDTRIP and the "USER" the cancellation, issuance and ticket sales policies of the national and international airlines, the IATA air ticket issuance, issuance and sale policies International and the Reservation and Cancellation Policies of this "SITE".

Once the air tickets have been issued in favor of the "USER", MEDTRIP is not responsible for any change of itinerary, or for any change or error in data provided by the "USER" for the issuance of air tickets, such as names , surnames, ages, sex, dates, routes, airlines, classes, categories, among others.

Therefore, MEDTRIP, informs the "USER" of the General Cancellation Policies of the tourist and medical services it offers:

 

  • Cancellation of air transport

When completing a flight reservation included in the package, a confirmation number will be generated, therefore, once the ticket is issued, it has the following restrictions:

 

  • Tickets issued are non-refundable.

  • Tickets are not transferable to another person or to another airline.

  • All changes in the date and time of the flight generate extra charges and are subject to availability.

 

If the "USER" needs to change the time or date of his flight, he must contact the CONTACT CENTER. All changes are subject to availability. The sooner you request the change, the more likely you are to find available seats on another flight. Additional charges for ticket changes depend on the dates on which the "CUSTOMER" wishes to travel, on the policies of each airline and the demand for each flight.

 

  • Cancellation of medical tourism package

Once the total reservation of the package has been made, the client has a maximum of 48 hours to cancel their reservation and request a 100% refund of the advance. The expenses caused by the transfer and exchange rate are borne by the client. After 48 hours, the advance is not refundable, there will only be the possibility of making a change of dates to reschedule the medical trip. All cancellation requests must be informed by the client in writing via e-mail to their assigned advisor, mentioning their reservation number.

 

If the package was paid in full or in part and the client cannot travel * to receive the contracted service, the amount that he had deposited or transferred is not refundable, however, the possibility of rescheduling his medical procedure is offered, up to twelve months after the date the trip was already scheduled, with a fare adjustment corresponding to the season. After the twelve months indicated, the money is not refundable without exceptions and the promotions might vary.

* Justified causes to reschedule the medical trip: Phenomena or natural catastrophes, sanitary restrictions of the country of origin and destination, physical disability, accidental accidents or illness of the patient (with written and verbal justification of the treating doctor), medical examination "Not Suitable" by part of destination specialist MedTrip.

 

  • Withdrawal law

Based on article 56 of the Federal Consumer Protection Law, the CLIENT may request the cancellation of the contracted services within the first five days after the date of purchase of the services.

 

In these cases, the OPERATOR may retain a sum of money, in accordance with the provisions of this section. According to the conditions of the rate, you may retain the agreed percentage, which may not exceed 10% of the value received for rate, excluding fees, taxes and administrative fee. The provisions herein shall not apply in the case of promotional rates. The OPERATOR must reimburse the money to the CLIENT within a maximum period of thirty (30) days from the communication of the withdrawal.

 

  • Disclaimer of responsibilities

By virtue of MEDTRIP as a Medical Tourism Agency (Operator), it provides services as a reservation agent only as an INTERMEDIARY between the "USER" and the PROVIDER or direct SUPPLIERS of the tourist and medical services promoted on this "SITE", no assumes or will assume any responsibility generated by the relationship between the "USER" and the End Providers of Services, for which the "USER" releases MEDTRIP from any responsibility, in the event of any failure or lack of compliance by the SUPPLIER or direct SUPPLIERS of tourist services, including without limitation any failure or compliance by airlines, hotels, transportation agencies, tour operators and in general, any failure or lack of compliance by all those medical services, whether laboratories, hospitals , medical specialists, who are provided directly by one or more SUPPLIERS and not directly ect by MEDTRIP.

 

Regarding the terms and conditions and / or policies of the direct SERVICE PROVIDERS. MEDTRIP will not assume any responsibility and the "USER" in this act releases MEDTRIP from all responsibility, as well as from any claim, cost, expense or loss that the "USER" may suffer including any personal injury or injury to third parties, accidents or death. , damage to personal belongings, loss of fun, anger, disappointment, anguish or frustration, whether mental or physical, provided they are the result of:

 

  • Acts or omissions of anyone other than MEDTRIP or its employees;

  • Illness, theft, labor disputes, quarantine, government actions, weather, or any other cause beyond the direct control of MEDTRIP;

  • Impossibility of the "CLIENT" to travel due to not having the required documents such as, but not limited to, passports with at least 6 (six) months of validity after the date the trip ends, visas, personal identification, prescriptions or documents medical and certificates, health permits and all the documents required by the authorities of Mexico and the countries you visit, we also inform you that some countries request that your passport must have at least two pages free of stamps or visas.

  • Any failure or fault on the part of the direct PROVIDER in providing the service;

  • Any failure or lack on the part of the "CLIENT" at the time of enjoying the contracted services;

  • Any failure or failure of the "CUSTOMER" to observe or comply with the terms and conditions, policies, instructions, medical recommendations, security measures among others of the final PROVIDERS of the service;

  • Cases of force majeure or acts of God such as: strikes, delays, flight cancellations, earthquakes, armed conflicts, hurricanes, and in general any other event that is unpredictable and that is not attributable to MEDTRIP;

  • Failure of the "CUSTOMER" to follow instructions, including, but not limited to flight departure times, time and date of entry and exit at hotels, and coupon exchange policies, pre or postoperative care;

  • Any other event that is not under the direct control of MEDTRIP.

 

Any claim or written notification against MEDTRIP must be received no later than 30 (thirty) days after the return from your trip; The "USER" will be responsible for reading and abiding by the terms and conditions and / or policies of the final SERVICE PROVIDERS.

The full refund will not be applicable in situations in which the trip has to be canceled, interrupted and / or postponed by MEDTRIP, for reasons beyond its control, force majeure, stated, but not limited to weather, hurricane, earthquakes, acts of terrorism, etc., and in which MEDTRIP's contractual obligations with its SUPPLIERS do not allow it to obtain reimbursement of the amount paid or to be paid to the SUPPLIER on behalf of the client. In any case, at MEDTRIP's discretion, 10% (ten percent) of the total amount paid for the reservation may be withheld through mediation and / or service charges, excluding fees, taxes and administrative fee.

In the event that the contracted services could not be provided partially or totally by the SUPPLIER, MEDTRIP may only on certain occasions manage on behalf of the "USER" the reimbursement of the appropriate amount or the reprogramming of the service, with MEDTRIP being relieved of any greater responsibility or commitment.

 

  • Disclaimer of responsibilities

These Terms and Conditions and any service or product sold in its capacity as INTERMEDIARY by MEDTRIP MÉXICO, will be governed by the laws and courts of the city of Colima, Colima, Mex. The "USER" declares that he knows the scope of this Contract, whose Terms and Conditions are the faithful expression of his will and are submitted in the event of non-compliance or interpretation to the jurisdiction of the Federal Consumer Attorney, in the administrative way, as conciliatory instance, to resolve the differences that may arise and if they subsist, the "USER" agrees to submit to the jurisdiction of the Laws and Courts of the city of Colima, Col., in turn renouncing any another jurisdiction that, due to their present or future domiciles or the location of their assets or their nationality, may correspond to them.

 

  • Patient safety and hygiene standards

Derived from the COVID-19 pandemic that has affected the world, most of our business partners (hospitals, hotels, carriers, tours and airlines) have implemented safety and hygiene protocols with the aim of providing quality service and travel insurance, including the request for Covid tests.

MEDTRIP has named patient safety as its priority, for which it has confirmed that the PROVIDERS of the final services have the corresponding implementation of hygiene protocols.

We reiterate that all hygiene and safety protocols adopted by the final SUPPLIERS are the responsibility of the latter, so MEDTRIP does not assume responsibility for the efficiency of said protocols.
